Dr. Cat Baker and the Florida Children's Institute, Inc. (DBA Positive Parenting Institute) team are thrilled to have you as part of our community. The service agreement below outlines the details of our relationship going forward.

This Agreement is being made between Florida Children’s Institute (DBA Positive Parenting Institute or PPI) 8777 San Jose Blvd Ste 502, Jacksonville, FL 32217 and CLIENT, United States. I will be referred to as “Coach” or “we” or “us” throughout the document and you will be referred to as “Client” or “you”. We both legally agree to the following:

Program Description

The Positive Parenting Institute VIP Community Membership program includes:

  • Monthly Group calls
  • Small intimate group of parents doing the same thing
  • Access to PPI Community Course materials
  • Four (4) 30-minute 1:1 support calls with Dr. Cat Baker
  • Access to Dr. Baker between calls via the Voxer voice/text messaging app
  • Additional 1:1 support from Dr. Cat Baker (as needed for an extra fee)

Payment

$775 USD per month charged to the credit card on file with Kajabi.

By making your 1st payment, you give us permission to automatically charge your credit card for each of the subsequent installments as payment for your Program.

Late Fee:

It is the responsibility of the Client to communicate any changes in the agreed payment method to the Community Manager prior to payment processing. For payment plans a $50 (USD) late fee per transaction will be charged for payment not received or unable to be processed by each monthly due date. This payment will be included in the second attempt at a monthly payment. Multiple missed payments will result in suspension of access to course content/community activities. Access will not be reinstated until the account is up to date. Multiple suspensions in access will result in required payment in full to maintain good standing in the program. Florida Children’s Institute, Inc. reserves the right to transfer payment issues to a collection agency.

Refund Policy:

If you do not feel this program meets your current needs within the first 15 days from registration date, your coaching contract will be terminated. Access to program content ends upon program cancellation.

Once 15 days have passed it is assumed and expected that you are fully committed to the financial and personal commitment to this program.

Confidentiality

Dr. Cat Baker respects the privacy of her clients, holds in strict confidence all information about clients and complies with applicable privacy and other legislation. No information will be released to a third party without your written permission. At any time, you have the right to withhold or withdraw consent, or place conditions on the disclosure of your information.

I understand that, by Federal Law, Florida Children’s Institute may not use or disclose protected health information without authorization except as provided in the Florida Children’s Institute Notice of Privacy Practices. By signing this Authorization, I am giving permission to Florida Children’s Institute for the uses and disclosures of the described protected health information. I hereby release Florida Children’s Institute and its employees from any and all liability that may arise from the release of the information that I have directed. I understand that I may be charged a fee of up to $1.00 per page for the first 25 pages and $.25 for each additional page for every page copied, and this fee is within the limits allowed by State Law. This Authorization may be used to disclose protected health information of the same type described above, which may be created in the future, until the expiration date.

I further understand that there are specific and limited exceptions to confidentiality which include the following: when there is risk of imminent danger to myself or to another person, the clinician is ethically bound to take necessary sets to prevent such danger, or when there is suspicion that a child or elder is being sexually or physically abused or is at risk of such abuse, the clinician is legally required to take steps to protect them and to inform the proper authorities. When a valid court order is issued for medical records, the clinician and the agency are bound by law to comply with such requests.

Email Confidentiality

Every time you send a regular email, your messages and your privacy are at risk of being viewed, intercepted or modified by 3rd parties. Email addressed to any email @FloridaChildrensInstitute.com is encrypted at 128 bit. Any information sent to @gmail.com addresses or via the Voxer app is NOT encrypted. FCI recommends that clients avoid sending sensitive information via unsecured means. FCI also recommends clients sign up for a secure email account to ensure that sensitive correspondence is kept confidential. Florida Children’s Institute, Inc. accepts no liability for any interference with or damage to your computer system, software, or data occurring in connection with your use of insecure email to communicate with Dr. Cat Baker or and FCI team member.

Risks and Benefits

There are risks and benefits to the Coaching process. Coaching may involve the risk of remembering unpleasant events and may arouse strong and/or unanticipated feelings. Benefits of Coaching may be an increased ability to live more effectively; improving your ability to cope with issues that arise in areas of your life such as interpersonal relationships, family, friends, and career. You may also gain a better understanding of yourself, your goals and your values which will assist you in your personal and career growth. Given the nature of coaching, it is difficult to predict or guarantee any particular outcomes. However, Dr. Cat Baker will do her best to help you experience its benefits. Dr. Cat Baker encourages you to discuss any questions or concerns with her at any point during this process. Dr. Cat Baker will refer you to the appropriate service providers should  your level of need exceed her area of expertise.

Your Responsibilities:

Personal commitment to coaching is crucial to success. It is important that you be active, open and honest with your coach. Your most important responsibility is to work toward the goals you and your coach have agreed upon. Seeing a coach is often enhanced with additional efforts made outside your work together. This effort can include thinking about the material covered in your sessions, monitoring the behaviors you are trying to change, or working on specific aspects of coaching such as keeping a journal, reading a book or article, or practicing a new skill. It is your responsibility to arrive at or before the time of your session. Each Coaching Session will end on time, regardless of whether you call in late.

By agreeing to this service agreement, you understand that Dr. Cat Baker, her team, and programs are guides and trainings. You understand that it is your responsibility to ask questions, seek feedback, engage, and take personal ownership for the results you desire to see.

LIMITATION OF LIABILITY

The Client is responsible for his/her own decisions, actions, and results. The Client agrees to hold Florida Children’s Institute and the Coach free from all liability for any action, advice, consultation and results, or adverse situations resulting directly or indirectly from coaching-related communications between the parties, including but not limited to any losses caused by any negligence on the part of Florida Children’s Institute, Dr. Cat Baker, or other team members. The Client agrees to indemnify, defend, and hold harmless Florida Children’s Institute and its agents, officers, and employees from and against any and all liability or expense, including defense costs and legal fees incurred in connection with claims for damages of any nature whatsoever including but not limited to bodily injury, death, personal injury, financial or business losses, worker’s compensation, past or future lost earnings, damage to reputation, or property damage arising from Florida Children’s Institute, Inc. performance or failure to perform obligations hereunder. We shall not be liable for any damages, loss, cost or expenses, including incidental or consequential damages, of Client. The Client's sole remedy against Florida Children’s Institute or the Coach shall be the replacement cost of coaching services.

FORCE MAJEURE

Florida Children’s Institute, Inc. or its representatives will not be in breach of its obligations under this agreement (other than to pay monies due) in the event that, for cause or causes beyond its control, the Coach is unable to perform, in whole or in part, any one or more of its obligations under this Agreement. Such causes shall include, but not be limited to fire or other casualty, inability to obtain materials or services, technical failure or difficulties, problems or interruptions with the Internet, computer viruses, snow storms, hurricanes, other acts of God, insurrection, or any other cause not within the reasonable control of either party.

Termination

The Coach may terminate this Agreement before completion of the total number of sessions detailed above, on written notice to The Client, where :

  • The Client fails to perform or observe any of the terms of this Agreement and fails to remedy a breach within 60 calendar days of written notice provided by The Coach concerning the failure, or
  • The Client fails to perform any term of this Agreement which is incapable of remedy, or
  • The Client cancels more than 3 Sessions during the Coaching Period, or An insolvency event occurs in relation to The Client (e.g. bankruptcy, arrangement or court order is made or proposed in relation to all or any of The Client’s assets), or
  • The Client fails to pay in advance/on day of session and fails to pay within 5 calendar days of the reminder notice date for that session, or

The Client may terminate this Agreement, on written notice to The Coach, where:

  • The Coach fails to perform or observe any of the terms of this Agreement and fails to remedy a breach within 5 calendar days of notice provided by The Client concerning the failure, or
  • The Client does not feel this program is a good fit within the first 15 days of registration.

Cancellation and Missed Appointment Policy

Regarding One on One coaching calls (if applicable):

If you need to reschedule a session, please send written notice at least 48 hours in advance to [email protected]. You will be able to make up the missed Coaching Session at an agreed-upon time during the Program. Otherwise, if less than 48 hours of notice is provided for cancellation or rescheduling, you will be forfeiting that appointment and unable to reschedule it. If you do have an emergency, we will work around it and make up the call. If you forget a call, we will not make it up.

Privacy Policy

We collect your name, address, email address and credit card information when you sign up for your program. We use this information to process transactions, to personalize your experience in your program, and to send you periodic emails. Your information will be shared in a secure manner with current representatives of Florida Children’s Institute, Inc. to pay for the program and to send you information pertaining to the program. Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of paying for and/or delivering the purchased service requested by you.

Informed Consent

Informed consent for coaching services is essential and out of respect for your right to self- determination. Consent must be given voluntarily, knowingly and intelligently. You have the right to change your mind and withdraw informed consent at any time.

Statement of Informed Consent

I have read and fully understand the information contained in this document. Any and all questions I have regarding the contents of this document have been answered to my satisfaction and I would like to proceed with individual coaching.
